Terms of Service

Formhub (formhub.me) is an online forms service run by Business Forms (ABN 71 660 552 223) ("we", "us"). These terms are an agreement between us and the business that opens a Formhub account ("you"). By creating an account or using Formhub, you agree to them.
1. What Formhub does
Formhub lets you build online forms, share them with a link or put them on your own website, and receive the answers. Answers are kept in your account, can be emailed to you as PDFs, and can be downloaded. Depending on your package, your forms can also take card payments and bookings.
2. Your account
- Formhub is for businesses and organisations. The person who opens the account must be at least 18 and allowed to act for the business.
- Keep your account details correct, and keep your passwords and two-factor login to yourself. You are responsible for what is done with the logins on your account.
- If you think someone else has got into your account, tell us straight away at admin@formhub.me.
3. Packages and paying
- You pay for your package in advance, monthly or yearly, by card through our payment provider, Stripe. Prices are in Australian dollars. Prices include GST.
- Your package renews automatically at the end of each period until you cancel.
- Each package has limits on logins, forms and responses a month. If you go over the response limit, every response is still saved, and we may ask you to move to a bigger package.
- If we change our prices, we'll email you at least 30 days before. The new price applies from your next renewal after that.
4. Money-back guarantee
If you're not happy with Formhub within 14 days of your first payment, email us and we'll refund that first payment in full and close your account. This applies to the first payment of a new account.
5. Cancelling
You can cancel any time from the Billing page. Your package keeps running until the end of the period you've paid for. After that, your account becomes read-only: you can still log in and see and download your responses, but your forms stop taking new responses. We don't refund part periods, except under the money-back guarantee or where the law requires it.
6. If a payment fails
If a renewal payment doesn't go through, your forms keep working for 7 days while you update your card. After that, your account becomes read-only until the payment is made.
7. Your forms and responses
- Your forms, and the answers people send through them, belong to you. You let us store, process, show and send them only so we can run Formhub for you.
- We look after responses on your behalf and follow your instructions. Our Privacy Policy explains how.
- You are responsible for what your forms ask for. That means making sure you're allowed to collect the information, telling the people who fill in your forms how you'll use it (your own privacy notice), and following the privacy and other laws that apply to you.
8. What you must not do
You must not use Formhub to:
- pretend to be another person, business or government body, or make a form that looks like it comes from someone it doesn't;
- trick people into giving their information, or ask for passwords, PINs, one-time codes or full card numbers (use the built-in card payments instead);
- publish anything illegal, threatening, hateful, or that harms other people;
- send spam or harmful files, or collect information about children without the consent the law requires;
- break the law or anyone else's rights;
- try to break into, overload or get around Formhub's security or package limits; or
- resell Formhub without our written agreement.
Every form has a "Report this form" link, and we look at every report.
9. When we can switch off a form or account
We may switch off a form or suspend an account straight away if we reasonably believe it breaks section 8, puts people's safety or security at risk, or if the law requires it. We'll tell you why, unless the law or someone's safety stops us. For other breaches of these terms, we'll tell you first and give you a fair chance to fix it.
10. Card payments in your forms
If your package includes card payments in forms, the payments go into your own Stripe account. You are the seller. Stripe's own terms apply between you and Stripe. We take no fee from these payments and never hold your money. Refunds and disputes with your customers are between you and them.
11. Keeping Formhub running
- We work to keep Formhub available at all times, but there may be short breaks for maintenance or problems outside our control.
- We back everything up every night. Please still download any responses you must keep for your own records.
- We keep improving Formhub and may change how features work. If we remove something important you use, we'll tell you first.
12. Our responsibility to you
Nothing in these terms takes away your rights under the Australian Consumer Law. As far as the law allows:
- if Formhub fails to meet a consumer guarantee, our responsibility is limited to supplying the service again or paying the cost of having it supplied again;
- in any other case, our total responsibility is limited to the amount you paid us in the 12 months before the claim; and
- we are not responsible for indirect losses, such as lost profits or lost business.
13. Closing your account and your data
You can download your responses at any time, and we recommend doing so before you leave. After an account closes, we keep its data for 90 days, so you can come back or download it, and then we may delete it. You can ask us to delete it sooner. Deleted data can stay in our nightly backups for up to 30 days.
14. Changes to these terms
If we make an important change to these terms, we'll email the account owner at least 30 days before it applies. If you don't agree with the change, you can cancel before then. If you keep using Formhub after that, you accept the new terms.
15. Law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales can hear any dispute about them.
